The RIAA may be celebrating after its recent landmark victory against LimeWire and its founder, Mark Gorton. Whilst celebrating they will no doubt be considering ways in which to scale up this success to remove the ’scourge’ of filesharing from the face of the earth.

Not so fast, boys. It’s going to be a lot more difficult than that.

It may be that Lime Wire lost out in this first battle, but that does not mean that it has lost the war. Nor does it mean that this approach will work with other filesharing networks or software: LimeWire got sloppy and a bit cocksure with their blatant abuse of copyright. This does not extend across the spectrum.

Also, Mr. RIAA, how do you intend to stop a distributed open source service like Ares in its many versions? Sue the owner? Who is that then? How about the developer…? Oh, it’s open source. What about those making money from the software? Nope again. Attacking something like Ares would be akin to trying to catch a wisp of smoke.

So the battle is not over for the RIAA. For filesharing, it is certainly not all lost.
